Courts can give pre-arrest bail outside jurisdiction: SC

The Supreme Court has ruled that high courts and session courts are not prohibited from considering anticipatory bail pleas. The court introduced the concept of transit anticipatory bail in which the accused can be protected from arrest until they reach a court with territorial jurisdiction for the alleged offense. The court stated that a restrictive interpretation of the law would undermine the constitutional rights of a personal liberty and access to justice for the individual.
